Zug Section submits FMG 37a postulate
In order to achieve the implementation of the federal article FMG/LTC 37a into cantonal law, the Zug HB9ZG section has now submitted a corresponding postulate to the State Chancellery of the Canton of Zug via a group of parlamentarians.
The drafting and submission were very carefully prepared. General renewal elections were held in the canton of Zug on 2 October. Before the elections, all parties took to the streets with stand actions and talked to the voters. This is the most important time in every legislature when our representatives listen to the people. The Zug section took this opportunity and sent a team to visit the parties’ stand actions on three Saturdays and explain our concerns to the parliamentarians in person. The attached flyer was handed out as a reminder.
It is crucial that our cause is accepted and supported by several political parties. This is exactly the same in other cantons. We were able to ensure this through personal discussions with the largest parties in the canton of Zug: SVP, FDP, Die Mitte and SP. These parties represent 65 of a total of 80 votes in the cantonal parliament. This means that the chances of getting the request “through” are good.
The draft postulate was submitted for preliminary examination to the State Chancellery and the building and security departments. The State Chancellery and the Building Directorate commented on it and drew our attention to a few small misleading details (which have since been corrected). However, both statements unanimously confirmed the postulate’s eligibility.
Once it has been submitted and placed on the Cantonal Council’s list of current business, the matter will be referred to the Government Council at the meeting on 24 November 2022. We can assume that we will win this vote. This will give the government a binding mandate for which it will have several months to prepare a report and submit it to parliament. Parliament can then express its opinion on this in a debate.
The Zug section is thus the first canton to seek a binding mandate from the government on antenna law, rather than a mere request for information (“interpellation”, usually ineffective). Previous attempts by sections to have article LTC 37a incorporated into cantonal or communal law, bypassing politics, did not bring the legal certainty demanded and deserved by radio amateurs. It is well understood that our concern is purely “political” and not “administrative”. That is why we are only in the right place with politics, but not with the administrations.
